HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.39912 of 2018 ORDER:

With the consent of both the counsel, this writ petition is being disposed of at the stage of admission.

This writ petition is filed seeking the following relief :- " ....... to issue a Writ, order or direction more particularly one in the nature of Writ of Mandamus to declare the entire action of the respondents in not paying family pension to the petitioners herein inspite of repeated requests since July 2010 onwards on the untenable ground that the earlier lbrahimpatnam Grama Panchayat formed as Municipality is as highly illegal, arbitrary, unjust, improper, violative of Articles 14, 16 and 300-A of the Constitution of India and consequently to direct the respondents to forthwith take necessary steps for making payment of family pension in respect of petitioners herein with interest at the rate of 24% p.a. from the date of stopping the family pension till actual payment is made ......." .

Heard Sri S.Satyanarayana Rao, the learned counsel for petitioner and the learned Standing Counsel for respondents. When the matter is taken up for hearing, the learned Standing Counsel appearing for respondents has produced proceedings dated 13.05.2019 and stated that the pension papers of the petitioners are forwarded to the District Audit Officer and the case of petitioner would be considered for grant of pension in accordance with the Rules.

This Court, having considered the submission made by the learned Standing Counsel, is of the c onsidered view that this writ petition can be disposed of directing the respondents to sanction pension to the petitioner, pursuant to proceedings dated 13.05.2019, within a period of two months from the date of receipt of a copy of this order.

With the above observations, the writ petition is disposed of. No order as to costs.

As a sequel, miscellaneous petitions pending, if any, in this writ petition shall stand closed.
