HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.883 of 2016 O R D E R :

The petitioner, who is accused in Crime No.375 of 2015 of Nagarampalem Police Station, Guntur, registered for the offences punishable under Sections 307, 497, 452, 506, 509 and 309 I.P.C., filed this petition under Section 438 of Cr.P.C. seeking anticipatory bail.

Heard the learned counsel for petitioner and the learned Additional Public Prosecutor and perused the material available on record.

The case of the prosecution is that the petitioner herein developed intimacy with the first informant and on 29-12-2015 at 12-00 noon the petitioner herein entered into the house of first informant and he pressed her neck in order to kill her and in that incident she received injury and when she raised cries, neighbours gathered.

Considering the facts and circumstances of the case, this Court is of the view that it is not a fit case to grant anticipatory bail to the petitioner-accused at this stage. Accordingly, the Criminal Petition is dismissed. ______________________ JUSTICE RAJA ELANGO 03rd February, 2016
