THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.39529 of 2014 ORDER:

Heard the learned Counsel for the petitioner and Smt.J.Koteswari Devi, learned Standing Counsel for the respondents. The petitioner established a sponge iron factory of the capacity of 200 TPD at Madhavaram Village, Mantralayam Mandal in Kurnool District. The respondents agreed to supply power of 1501 KVA on 33 KV transmission line under HT-1 category in three phases. The first phase of 400 KVA was released on 09.02.2010. The second and third phases were rescheduled by memo dated 14.06.2010. The second phase was released on 25.06.2010 and the third phase of 601 KVA was to be released on 09.02.2011. The said date of release was further extended up to 09.02.2012. In view of the unsteady power supply, the petitioner applied to the second respondent on 14.10.

2014 for deration of demand from 900 KVA to 500 KVA, and the said representation was followed by another representation dated 26.11.2014. When there was no response from the respondents, the present Writ Petition is filed. Though the learned Standing Counsel took time on 24.12.2014 for getting instructions, no instructions are received by the learned Standing Counsel.

In view of the above, this Writ Petition is disposed of directing the second respondent to consider the application of the petitioner dated 14.10.2014 as per condition No.5.9.4.2 of the terms and conditions of supply, within a period of fifteen days from the date of receipt of a copy of this order and communicate the same to the petitioner. The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
