THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.39900 OF 2016 ORDER:
This Writ Petition is filed under Article 226 of the Constitution of India seeking to declare the action of the 2nd respondent in registering the crime No.416 of 2016 on the file of the Sangareddy Rural Police Station, Sangareddy, Sangareddy District, dated 11-11-2016 against the petitioners, as illegal, arbitrary and consequently set aside the crime No.416 of 2016 on the file of the Sangareddy Rural Police Station, Sangareddy, Sangareddy District, dated 11-11-2016.
The main contention raised by the learned counsel for petitioners is that petitioners have already filed O.S.No.87 of 2015 for declaration of title in favour of the 1st petitioner herein and also obtained interim injunction. Thereafter, the present complaint lodged by the 3rd respondent herein aggrieved over the said suit. It is the case of petitioners that they are the genuine purchasers of the said property.
Considering the said submissions, the respondent No.2 is directed to complete the investigation without arresting petitioners - accused Nos.1 to 4 and file final report, if any, in accordance with law. At the same time, petitioners are directed to appear before the respondent No.2 as and when required for the purpose of obtaining handwriting or any signatures of
petitioners, since the offences alleged include Sections 468 and 471 I.P.C.
Accordingly, the Writ petition is disposed of. No order as to costs.
Consequently, the miscellaneous petitions pending in this petition, if any, shall stand closed.
