HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 40009 of 2018 ORDER:

1) Heard learned counsel for the petitioner and Sri Md.Saleem, learned Standing Counsel for Municipal Corporation. With their consent, the writ petition is disposed of at the admission stage. 2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent No.2 in not granting permission for demolition of the structures in premises bearing D.No.6-8771, correspondent to new D.No.69-S-6-167, situated at Sanjeevaiah Nagar, Alipiri Road, Tirupati, Chittoor District, and re-construction of the new house, in spite of submitting the representation dated 10.09.2018, as illegal and arbitrary.

3) Learned counsel for the petitioner would submit that though the petitioner made a representation on 10.09.2018, seeking permission to demolish the structures in his own premises bearing D.No.6-8-771, correspondent to new D.No.69-S-6-167, situated at Sanjeevaiah Nagar, Alipiri Road, Tirupati, Chittoor District, till date no action has been initiated.

4) Learned Standing Counsel would submit that if the application is made by the petitioner and if it is still pending consideration, direction may be given to the authorities to deal with the same, in accordance with law.

5) Accordingly, the writ petition is disposed of directing the authorities to deal with the representation dated 10.09.2018, seeking removal of structures in premises bearing D.No.6-8-771, correspondent to new D.No.69-S-6-167, situated at Sanjeevaiah Nagar, Alipiri Road, Tirupati, Chittoor District, in accordance with law, if it is still pending consideration, as early as possible, preferably within a period of four weeks from the date of receipt of a copy of the order. 6) Miscellaneous petitions, pending if any, shall stand closed in the light of this final order.
