THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No. 10819 OF 2017 ORDER:

This petition under Section 482 of Cr.P.C. is filed to quash the proceedings in P.R.C.No. 11 of 2016 on the file of the Court of VI Metropolitan Magistrate, Cyberabad at Medchal.

Learned Public Prosecutor (T.S.) placing reliance on Umesh Kumar Vs. State of Andhra Pradesh1 would contend that the proceedings at P.R.C. stage cannot be quashed. As per the principle laid down in Umesh Kumar (supra), at the stage of P.R.C., the proceedings cannot be quashed since no legal proceedings are pending against the petitioners as on that date. However, the petitioners are permitted to renew their request at appropriate stage. 3.

With the above observation, the petition is dismissed. Pending miscellaneous petitions, if any, in this petition shall stand dismissed in consequence.
