HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.3 9 9 3 0 of 2 0 1 8 ORDER: - When the matter is taken up, the written instructions furnished by the Sub-Divisional Police Officer, Gudur, SPSR Nellore District, dated 10.12.2018, are placed on record by the learned Government Pleader. The said instructions read as under: - "It is submitted that the petitioner herein is the wife of the brother of the accused, namely Meganuru Harikrishna, in Cr.No.300/ 2018, dated 18.09.2018, under Sections 452, 354-A and 506 I.P.C., of Chillakur Police Station, registered basing on the statement of the victim/ complainant therein, one Meganuru Mounikia, W/ o.Srinivasulu, aged 25 years, wherein the Sub-Inspector of Police & S.H.O., Chillakur P.S., is the Investigating Officer. It is submitted that all the allegations of the petitioner against the 5th respondent in respect of conducting investigation in Cr.No.300/ 2018 are not correct and hereby denied. In this connection, the petitioner has filed a private complaint against the 5th respondent before the Hon'ble AJFCM Court, Gudur.

Thereon, the Hon'ble Court, vide C.F.No.2762/ 18 (Dis.No.900, dated 24.09.2018) forwarded the same to the Sub-Divisional Police Officer, Gudur, for enquiry and report. Thereon, the Sub-Divisional Police Officer, Gudur, got conducted an enquiry on the allegations of the petitioner made in the said private complaint, wherein all the allegations of the petitioner made against the 5th respondent herein are found false and baseless. Accordingly, the Sub-Divisional Police Officer, Gudur, has submitted his report, dated 23.10.2018, before the Hon'ble AJFCM Court, Gudur.

Apart from the above, the petitioner has made the representation, dated 01.10.2018, before the Grievance Cell of the Superintendent of Police, SPS Nellore District, making certain allegations against the 5th respondent herein. On receipt of the same, the same was forwarded to the Sub-Divisional Police Officer, Gudur, for enquiry and report vide Endt.N.Dis.No.7306/ G3/ 18, of the Superintendent of Police, SPS Nellore District. Thereon, the SubDivisional Police Officer, Gudur has go conducted an enquiry on the allegations of the petitioner through

Inspector of Police, Gudur Rural and submitted report vide C.No.320/ G-SDPOG/ 2018, dated 07.12.2017, wherein all the allegations of the petitioner made against the S.I. of Police & I.O., in Cr.No.300/ 2018, are found false and baseless. In view of the facts and circumstances stated supra, it is submitted that there has been no illegality or irregularity in the investigation conducted by the 5th respondent in Cr.No.300/ 2018, as alleged by the petitioner in the affidavit. Further, on the representations made by the petitioner against the 5th respondent, necessary enquiry was conducted and found the allegations of the petitioner made against the 5th respondent are false and baseless and made only to circumvent the investigation in Cr.No.300/ 2018. Therefore, there is no inaction on the part of the respondent Police authorities in taking action on the representations/ complaints of the petitioner herein. All other allegations of the petitioner against the respondent Police authorities are incorrect, untenable and hereby denied."

Accordingly, the Writ Petition is disposed of, by placing on record the said instructions furnished by the Sub-Divisional Police Officer, Gudur, SPS Nellore District, dated 10.12.2018. However, it is open for the petitioner herein to avail the remedies open, strictly in accordance with law. Miscellaneous petitions pending, if any, shall stand disposed of.
