2016-12-19Raja Elango2 pages

HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.44025 of 2016 ORDER:

1.

This writ petition is filed by the petitioners under Article 226 of the Constitution of India seeking to direct the 3rd respondent not to call them to the police station and not to compel them to settle the civil disputes with respondents Nos.4 to 11.

2.

Heard and perused the material available on record. 3.

It is the grievance of the petitioners that there are civil disputes with regard to the subject property between the petitioners and respondents Nos.4 to 11. It is stated that at the instance of respondents No.4 to 11, the 3rd respondent is calling the petitioners and compelling them to settle the civil disputes.

4.

Considering the facts and circumstances of the case and the grievance of the petitioners, this Court is inclined to pass the following order:

"The 3rd respondent is directed not to call the petitioners to the police station without there being any crime against them and not to compel them to settle the civil disputes between them and respondents Nos.4 to 11. However, this order does not stand in the way of the 3rd respondent in proceeding against the petitioners, if any crime is registered against them for cognizable offence." 5.

With the above direction, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed. ________________ RAJA ELANGO, J Date: 19th December, 2016 Nn
