HONOURABLE SRI JUSTICE SANJAY KUMAR CONTEMPT CASE No.1887 of 2016 ORDER:

This Contempt Case was instituted alleging willful disobedience to the order dated 29.4.2016 passed in Writ Petition No.15343 2016. By the said order, the authorities of the Greater Hyderabad Municipal Corporation were directed to apply their mind to the representations made by the writ petitioner in relation to the alleged unlawful constructions being made by the unofficial respondents in the Writ Petition and take action thereon, if warranted, after giving an opportunity of hearing to all parties concerned, in accordance with the due procedure. Alleging that no action was taken, the writ petitioner filed this Contempt Case. Sri N.

Ashok Kumar, learned counsel for the respondent, the Commissioner of the Greater Hyderabad Municipal Corporation, would inform this Court that pursuant to the aforestated order, proceedings were initiated against the unofficial respondents in the Writ Petition and orders were also passed under Section 636 of the Greater Hyderabad Municipal Corporation Act, 1955. Learned counsel would state that owing to Writ Petitions being filed, one after the other, by the unofficial respondents in the Writ Petition, the Corporation was unable to take any firm action. In the light of the aforestated facts, this Court is of the opinion that no disobedience, much less willful disobedience, can be attributed to the respondent warranting exercise of contempt jurisdiction.

SK, J CC.No.1887 of 2016 Dt:12.7.2019 The Contempt Case is accordingly dismissed leaving it open to the petitioner herein to pursue her remedies in accordance with law be it in the pending Writ Petitions or otherwise.
