HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.43659 of 2016 ORDER:

This writ petition is filed seeking to declare the action of the 3rd respondent in interfering with petitioners' personal life and liberty by pressurizing the petitioners to hand over the hand loan agreement, dated 15.05.2015, to the 4th respondent and also to forego the amount which was lent to the 4th respondent by the petitioner, as illegal and arbitrary and consequently direct the 3rd respondent not to interfere with petitioners' personal life and liberty and also not to pressurize the petitioners to hand over the hand loan agreement, dated 15.05.2015, to the 4th respondent and also not to insist the petitioners to forego the amount lent to the 4th respondent.

Heard and perused the material available on record. The case of the petitioners is that the 1st petitioner, at the request of the 2nd petitioner, who is his friend, has lent an amount of Rs.5,00,000/- to the 4th respondent on 20.02.2015 and the 4th respondent paid an amount of Rs.3,00,000/- and executed a loan agreement, dated 15.05.2015, in favour of the 1st petitioner, for the remaining amount, but the 4th respondent has not paid the remaining amount till date and that the 4th respondent has approached the 3rd respondent and that on 10.12.2016, the police constables of the 3rd respondent called the petitioners to the police station and threatened them to forego the hand loan amount and also demanded the 1st petitioner to hand over the hand loan agreement, dated 15.05.2015, to the 4th respondent, otherwise, the petitioners will be implicated in false criminal cases. The main

grievance of the petitioners is that the 3rd respondent is pressurizing the petitioners to get settle the issue with the 4th respondent and threatening the petitioners that they would be implicated in false criminal cases.

Considering the grievance of the petitioners, the 3rd respondent is directed not to interfere with the affairs of the petitioners and the 4th respondent, more particularly, with the disputes pending between them. However, this order will not stand in the way of the 3rd respondent to register a case, if any complaint is lodged against the petitioners for cognizable offence. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
