THE HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No. 39115 OF 2016 O R D E R:
Petitioner prays for the following relief:
" ............ Writ of Mandamus declaring that the highhanded acts, deeds and things of the 2nd respondent in issuing notice dated 31.10.2016 in RC RG2 No. 141455 of 2016 without acquiring petitioner house property bearing door No. 40-9/11-1 land under Land Acquisition Act is illegal, arbitrary and violative of principles of natural justice." The counsel for petitioner, after carefully re-reading the notice dated 31.10.2016, requests the Court to permit the petitioner to submit explanation including objections the petitioner has against the notice and Respondents 2 and 3 can be directed to consider and dispose of the same.
The statement is placed on record.
The Writ Petition is disposed of accordingly. The petitioner is given liberty to file explanation/objections within three days from today and the respondents are directed to consider and pass orders within two weeks thereafter. For a period of two weeks, the demolition apprehended by petitioner of the premises covered by the notice alone is stayed. No costs.
Consequently, the miscellaneous applications, if any shall stand closed.
