WRIT PETITION NOs.36205 & 40287 OF 2018 COMMON ORDER:

Heard learned counsel for petitioners in the respective writ petitions, learned Government Pleader for respondent No.1 in W.P.No.36205 of 2018, and learned standing counsel for Northern Power Distribution Company Limited in both writ petitions. Both writ petitions concern same property and one of the electricity supply connection is same. By this order both writ petitions are disposed of.

In W.P.No.36205 of 2018, the grievance of petitioner is without giving opportunity to him, electricity power supply connection to Service No.226488224 in house No.2-4-1204/19, T.V.Tower Colony, Hanamkonda is disconnected, causing hardship and suffering to him.

On 05.10.2018, this Court granted interim direction as prayed for.

Learned standing counsel informs the Court that power connection is now restored. In view of the same, learned counsel for petitioner fairly submits that there is no subsisting grievance to the petitioner. In view of the restoration of power supply, no further orders are required in W.P.No.36205 of 2018 and is according disposed of.

In W.P.No.40287 of 2018, the grievance of petitioner is that even though name of petitioner is reflected in the respondentcompany records against service connection Nos.226488224,

226488883, 226479721 and 226488223, the monthly electricity bills are not generated on his name.

According to the respondent-company, since the Court of III Additional District Judge, Warangal granted status quo in I.A.No.125 of 2018 in O.S.No.49 of 2018 (renumbered as I.A.No.305 of 2018 in O.S.No.78/2018 on the file of II Additional District Judge, Warangal), further steps are not taken. The suit was instituted by petitioner in W.P.No.36205 of 2018 and petitioner in W.P.No.40287 of 2018 is one of the defendants. 7.

When the matter is taken up for consideration, counsel for petitioners in both writ petitions agree that the order of status quo was with reference to the property in issue, but not with reference to electrical power supply. Learned counsel Sri P.Mehear Srinivasa Rao counsel for petitioner in W.P.No.36205 of 2018 submits that any change in the electricity connection records and generation of bills in the name of petitioner in W.P.No.40287 of 2018 should not have impact on the pending suit in the Court of II Additional District Judge, Warangal, to which submission learned counsel for petitioner in W.P.No.40287 of 2018 fairly agrees. 8.

Having regard to these submissions, W.P.No.40287 of 2018 is disposed of, directing the respondents to reflect the name of petitioner in W.P.No.40287 of 2018 in the monthly electricity bills generated by the respondent-company. However, it is made clear that merely because name of petitioner is reflected in the respondent-company records and bills are generated in his name do not have any impact in the pending suit instituted by petitioner
