HON'BLE Dr. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.14177 OF 2014 ORDER:

This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed by the petitioners-accused to quash the proceedings against them in Crime No.235 of 2014 of Chikkadapally Policel Station, Hyderabad, registered for the offences under Section 506 I.P.C. and Section 3(1)(x) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act.

Heard the learned counsel for the petitioners, learned Assistant Public Prosecutor representing the respondent-State and perused the record.

Learned counsel for the petitioners would submit that the petitioners are mother and son, they are the owners of the subject property; when they demanded the building rent from the 2nd respondentde facto complainant, this false case is foisted against them in order to coerce them; and ultimately, prayed to allow the criminal petition. 4.

On the other hand, learned Assistant Public Prosecutor opposed the grant of relief sought for by the petitioners. 5.

In the view of the submissions, the interest of the petitioners is required to be protected. The truth or otherwise of the allegations made in the report dated 24.04.2014 requires examination. Under these circumstances, the investigating officer is directed to complete the investigation without arresting the petitioners-A.2 and A.3 in this case and file final report.

With the above direction, the Criminal Petition is disposed of. The interim order granted on 05.12.2014 stands vacated. Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed. ________________________ Dr. SHAMEEM AKTHER, J Date: 15-03-2018 siva
