HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.40042 OF 2018 ORDER :

The case of the petitioner is that petitioner's grand father was allotted house site patta on 15.06.1968 in Sy.No.320 in Layout No.1, Block No.II, Plot No.1 to an extent of Ac.0.05 cents, situated at Korumilli Village of Ramachandrapuram Taluq with boundaries North: Vacant Poromboku Land (presently constructed C.C road), East: Plot No.14 (Dadala Satyanarayana constructed house), South: Plot No.2 (site of school), West: Street (constructed C.C. road); that the petitioner has inherited the said land from his father and was also allotted House No.4-23 of Addinkivarilanka Gram Panchayat of Kapileswarapuram Mandal of East Godavari district and also paying taxes to the Gram Panchayat. The petitioner is now constructing house in the said land. While so, the respondent authorities are interfering with his possession and construction. Aggrieved by the same the petitioner filed the present writ petition.

Heard learned counsel for the petitioner.

On the other hand learned Assistant Government Pleader basing on the written instructions submits that petitioner is making construction in Survey No.321/2 which is classified as Government land belonging to the Education

Department wherein school play ground is situated, instead of R.S.No.320/2.

Learned counsel for the petitioner states that the petitioner will make constructions only in Survey No.320/2. In view of the aforesaid facts and circumstances, the writ petition is disposed of directing the respondent authorities not to interfere with the construction of the petitioner made in Survey No.320/2. If the petitioner tries to make construction in Survey No.321/2, the respondent authorities have every right to stop the same. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 09.11.2018 t k.
