HON'BLE Dr. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.10540 OF 2017 ORDER:
This Criminal Petition is filed by the petitioner-A.2 under Section 438 of Cr.P.C. to grant him anticipatory bail in Crime No.114 of 2017 of Atmakur Police Station, Warangal District, registered for the offences punishable under Sections 366-A, 368, 376(2)(n), 506 and 109 I.P.C. and Sections 5(1) and 6 of the Protection of Children from Sexual Offences Act, 2012.

Heard the learned counsel for the petitioner-A.2, and the learned Additional Public Prosecutor appearing for the respondent-State, apart from perusing the material available on record. 3.
The specific allegation against the petitioner-A.2 is that he has instigated A.1 to marry the victim. As per the contentions, there was a love affair between A.1 and the daughter of de facto complainant. The age of the de facto complainant is mentioned as 19 years in the first information report lodged with the police.

Having regard to the above facts and circumstances of the case and in view of the principle enunciated by the Hon'ble Supreme Court in Arnesh Kumar v. State of Bihar1, the Station House Officer, Atmakur Police Station, Warangal District, is directed to invoke the provisions of Section 41A Cr.P.C. against the petitioner-A.2 in Crime No.114 of 2017.

Accordingly, this Criminal Petition is disposed of. As a sequel, miscellaneous petitions, if any, pending in this Criminal Petition shall stand closed.
