This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/ accused, for grant of anticipatory bail in the event of his arrest in Crime No.169 of 2017 on the file of the Women Police Station, Begumpet, Hyderabad, registered for the offence punishable under Section 498-A of I.P.C.

Heard the learned counsel for the petitioner/ accused, learned Additional Public Prosecutor representing the respondent-State and perused the record.

The learned counsel for the petitioner/ accused would submit that the de-facto complainant, wife of the petitioner/ accused, stayed with the petitioner/ accused only for short time. Thereafter, she left his company on her own. No alleged incident has happened as mentioned in the report lodged with the police and prayed to grant anticipatory bail to the petitioner/ accused.

The learned Additional Public Prosecutor opposed the grant of anticipatory bail to the petitioner/ accused stating that there are grave allegations, constituting offence punishable under Section 498-A of I.P.C.

There is record to show that marriage between the parties took place on 21.08.2016. Thereafter, they left to Malaysia. At

Dr.SA, J CRL.P.No.10428/2017 Malaysia, the petitioner/ accused did not provide the necessities to the de-facto complainant, left her to her own fate in foreign country. Thereafter, the de-facto complainant returned to India on 05.05.2017.

The petitioner thrashed the de-facto complainant, tried to kill her and due to the heavy beatings, she fell unconscious. Thereafter, she was taken to a doctor. During the marriage also, huge amount of dowry and other properties were given to the petitioner/ accused. Grave allegations are made against the petitioner/ accused constituting offence punishable under Section 498-A of I.P.C. Therefore, it is not a fit case to allow this application.

Hence, this Criminal Petition is dismissed.

Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
