Aggrieved by the inaction of the 2nd respondent - Sub Registrar in registering the sale deed presented by the petitioner in respect of subject land in pending document P.No.162 of 2015, the present writ petition has been filed. Heard the counsel for the petitioner and the learned Assistant Government Pleader for Stamps and Registration.
Since the document presented by the petitioner is pending, without expressing any opinion on merits, the writ petition is disposed of at the stage of admission directing the 2nd respondent - Sub Registrar, Parvatipuram, Vizianagaram District to consider the registration of the document presented by the petitioner in P.No.162 of 2015 if the same is in order as per provisions of the Indian Stamp Act, 1899 and the Registration Act, 1908 and the Rules made there under. In case, if he intends to refuse to register the same, shall pass orders under Section 71 of the Registration Act, 1908 recording reasons and communicate the same to the petitioners. This exercise shall be completed within a period of six weeks from the date of receipt of a copy of this order. No order as to costs.
