HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.40089 OF 2018 O R D E R :

This writ petition is filed challenging the action of the 2nd respondent in not considering the representation of the petitioner dated 27.09.2018 for cancellation of the partition deed executed by third parties in respect of the subject land. Learned Assistant Government Pleader for Revenue submits that the respondent authorities have no power to cancel the registered partition deed.

Heard Sri Chatla Madhu, learned counsel for the 3rd respondent.

When the learned counsel for the petitioner was asked under which provision of law the respondents have power to cancel registered partition deed, he could not bring to the notice of this Court any provision of law empowering the respondents to cancel registered partition deed. In view of the same, no relief can be granted.

Accordingly, the writ petition is disposed of granting liberty to the petitioner to avail alternate remedy as may be available to the petitioner in respect of his grievance. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
