THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.34403 of 2016 ORDER:

Heard the learned counsel for the petitioner, the learned Government Pleader for Endowments representing respondent Nos.1 to 3, and the learned Standing Counsel for Endowments representing respondent No.4.

It is the case of the petitioner that Gandla Community people have constructed the fourth respondent - Temple, long back, with their own funds. It is the further case of the petitioner that the third respondent has not appointed the Trust Board to look after the affairs and day to day management of the fourth respondent - Temple. The petitioner submitted a representation to the second respondent on 05.09.2016 with a request to constitute the Trust Board for the fourth respondent - Temple. For one reason or other, the second respondent has not disposed of the said representation of the petitioner.

At the time of arguments, the only relief sought for by the learned counsel for the petitioner is to direct the second respondent to consider the representation of the petitioner dated 05.09.2016. The learned Government Pleader also consented for the same.

In view of the submissions made by the learned counsel for both parties, this Court is not inclined to express any opinion touching the merits of the main case.

Having regard to the facts and circumstances of the case and also the submissions made by the learned counsel for both parties, the second respondent is hereby directed to consider the representation of the petitioner dated 05.09.2016 and pass appropriate orders in the light of the provisions of the Andhra Pradesh Charitable and Hindu Religious Institutions and Endowments Act, 1987 and the Rules made thereunder, as expeditiously as possible, preferably within a period of two (2) months from the date of receipt of a copy of this order. 6.

With the above direction, the Writ Petition is disposed of. No costs.

Consequently, Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
