HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.40017 of 2018 ORDER:

This writ petition is filed challenging the notice vide Ref.B/02/2018, dated 23-10-2018, wherein and whereby the petitioner was directed to produce relevant documents pertaining to D.No.41-2-62/2/1, Veerabhadra Nagar, Rajahmundry.

Learned counsel for the petitioner submits that the 2nd respondent-Tahsildar has no power to issue such notice. On the other hand, learned Assistant Government Pleader for Revenue says that though the petitioner was granted house site patta in the year 1986, he was conducting business in the said site without constructing the house and complaints were received from the neighbours. On that the impugned notice was issued to attend the enquiry.

Normally this Court will not interfere with the issuance of notice. The notice also says that if the petitioner does not produce relevant documents, action will be taken in accordance with law.

In view of the same, it is open for the petitioner to submit relevant documents and explanation in pursuance to the notice dated 23-10-2018. Basing on the explanation and documents submitted by the petitioner, it is open for the respondents to take appropriate action in accordance with law, in case the petitioner commits any act of nuisance. Till then, the petitioner shall not be dispossessed from the subject site.

Accordingly, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
