HON'BLE SRI JUSTICE U. DURGA PRASAD RAO CIVIL REVISION PETITION No.2638 of 2016 ORDER :

In this civil revision petition, the petitioners/defendants are challenging the issues framed by the trial Court, more particularly, issue Nos.4 and 6.

2. Heard Sri Kowturu Vinaya Kumar, learned counsel for petitioners and Sri Mummaneni Srinivasa Rao, learned counsel for respondents.

3. During the course of hearing, it is agreed by both the parties that the petitioners/defendants will approach the trial Court and file an appropriate application for recasting of the issues and counsel for petitioners requested that a direction may be given to the trial Court to dispose of the said application on merits expeditiously.

4. In the light of above submission, this civil revision petition is disposed of at the admission stage with a liberty to the petitioners/ defendants to move the trial Court by an appropriate application for recasting of the issues already framed, and in such an event, the trial Court, after hearing both parties, shall pass an appropriate order thereof within two months from the date of filing of such an application.

5. The civil revision petition is disposed of accordingly. No costs.

Pending miscellaneous applications, if any, shall stand closed.
