HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION Nos.9856, 9860 and 9861 OF 2017 COMMON ORDER:

These Criminal petitions are filed by the same petitioners/ accused under Section 482 Cr.P.C. to quash the proceedings in F.I.R.No. 342 of 2016 of Kamareddy Police Station, Nizamabad District and F.I.R.Nos.224 and 225 of 2016 of Devanpalli Police Station, Nizamabad District, registered for the offences punishable under Sections 420 and 506 I.P.C.

Heard the learned counsel for the petitioners and the learned Public Prosecutor representing the State before ordering notice to the 1st respondent in the respective criminal petitions and perused the grounds urged in the quash petition, the contents of F.I.R. and other material on record.

A perusal of the material no way interdicts the investigation, mainly on the ground that there is a delay in reporting the occurrence more than five years respectively. There is no limitation bar for the offence under Section 420 I.P.C. However, the petitioners/ accused shall not be arrested pending investigation in the respective crimes and the investigation shall go on. This will not prevent the Police to secure the presence of the petitioners/ accused for the purpose of investigation as and when required.
