THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.23992 OF 2016 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the inaction of the first respondent in passing any order on the appeal and stay petition failed by the petitioner on 14.07.2016 as against the suspension order issued by the second respondent vide notice No.1374/2015/A2 dated 12.05.2016 under Section 249(6) of A.P.Panchayat Raj Act, 1994 is illegal, void and opposed to Articles 14, 19 and 21 of Constitution of India.

Heard the learned counsel for the petitioner, the learned Government Pleader for Panchayat Raj and Rural Development and Sri G.Narender Reddy, the learned Standing Counsel for Z.P.P.- M.P.P.-G.P.P.

The predominant contention of the learned counsel for the petitioner is that the second respondent passed the order dated 30.06.2016 without following the procedure as contemplated under the provisions of the A.P.Panchayat Raj Act. Feeling aggrieved by the order of the second respondent, the petitioner preferred an appeal before the first respondent. He further submitted that the petitioner also filed a petition with a prayer to suspend the order of the second respondent dated 30.06.2016.

Having regard to the facts and circumstances of the case, the first respondent is hereby directed to dispose of the appeal, as expeditiously as possible. There shall be interim suspension of the order of the second respondent dated 30.06.2016 till disposal of the appeal.

Accordingly, the Writ Petition is disposed of. No costs.

Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
