S.Venkat Reddy ..... PETITIONER AND State of Andhra Pradesh, Rep.by its Principal Secretary, Home Department, Secretariat Buildings, Hyderabad and 11 others .....RESPONDENTS Counsel for the Petitioner : Mr.P.V.KRISHNAIAH Counsel for Respondents Nos.1 to 6 : G.P.for Services (AP & TG) The Court made the following:

THE HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY & THE HON'BLE SRI JUSTICE M.S.K.JAISWAL

WRIT PETITION No.9664 of 2016 JUDGMENT: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This writ petition is filed for a mandamus to direct respondents Nos.1 to 6 to implement report vide C.No.E1/137/2014, dated 11.08.2014 of respondent No.5, as per order in O.A.No.1972 of 2015, dated 16.04.2015 of the Andhra Pradesh Administrative Tribunal, Hyderabad (for short "the Tribunal").

A perusal of the record shows that in the above mentioned O.A. filed by the petitioner, the Tribunal has directed the above mentioned respondents to consider report in C.No.E1/137/2014, dated 11.08.2014 of respondent No.5 and pass appropriate orders expeditiously. The learned counsel for the petitioner submitted that as the aforementioned order of the Tribunal was not implemented, his client has filed contempt case and the same is pending. He has further submitted that the Tribunal has not been taking up the contempt case. A perusal of the prayer sought by the petitioner shows that no specific direction is sought by him to dispose of the contempt case.

As relief claimed by the petitioner in this writ petition was already granted by the Tribunal and the contempt case is pending for enforcement of the said relief, we are not inclined to entertain this writ petition. If the contempt case is not being taken up by the Tribunal, the petitioner shall be free to make a request to take up the case early and if such request is made, we have no doubt the Tribunal will favourably consider such request and dispose of the same as expeditiously as possible.

Subject to the liberty given to the petitioner and the observations made as above, this Writ Petition is dismissed. No order as to costs. As a sequel to dismissal of the Writ Petition, WPMP No.12209 of 2016, filed by the petitioner for interim relief, is disposed of as

infructuous.
