THE HONOURABLE Dr.JUSTICE B.SIVA SANKARA RAO Criminal Petition No.10275 of 2017 ORDER :

Heard the learned counsel for the petitioners/ A.1 and A.2 of C.C.No.103 of 2008 on the file of the XIX Addl.Chief Metropolitan Magistrate, at Secunderabad, which is outcome of private complaint of the 2nd respondent, taken cognizance for the offence u/ Sec.138 of the Negotiable Act(for short, 'the Act') against them and also the learned Public Prosecutor for the 1st respondent-State and perused the grounds urged in the quash petition and the docket order of the Court dt.16.10.2017 dismissing the Section 317CrPC application to condone the absence of the accused for the non-compliance with the conditional order of the appearance by issuing the N.B.W. executable by 23.10.2017.

There is nothing to find fault with the Court in issuing the NBW but for to say, the petitioners/ A.1 and A.2 shall appear by virtue of this order before the Court to serve the purpose of NBW and then execute a bond with or without sureties as directed by the learned Magistrate for future due appearance as contemplated u/ sec.88CrPC.

Having regard to the above and in the result, the Criminal Petition is disposed of. Consequently, pending miscellaneous petitions, if any, shall stand closed.
