HON'BLE THE CHIEF JUSTICE SRI THOTTATHIL B. RADHAKRISHNAN AND HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No. 40056 OF 2018 Order : (Per The Hon'ble The Chief Justice Sri Thottathil B. Radhakrishnan) This Writ Petition stands with the admitted position that the writ petitioner had wrongly bubbled in his O.M.R. sheet, in relation to the Question Booklet Number in Paper-II. The petitioner seeks a direction that his O.M.R. answer sheet has to be evaluated by the competent authority in connection with the recruitment for the posts of Junior Panchayat Secretaries.

In this age of computerization, if such matters are to be entertained and relief granted, that will have far reaching adverse consequences on appropriate management of the regime of duly constituted authorities for conducting selection. More importantly, it needs to be noted that wrong bubbling of the Question Booklet Number is itself a situation where the connectivity between the booklet and the candidate gets lost out of the zone of such precision, as is required to be obtained in such matters. We are also fortified in taking the view that the better interest of administration in relation to conducting of tests of such nature would be jeopardized if such erroneous wrong bubbling is replaced or laced off through judicial orders thereby, compelling evaluating sector to carry on with the evaluation. We are fortified in taking this view by the judgment of this Court in Writ Petition (TR) No. 3245 of 2017. We do not see any other way of looking at the matter, except to concur with the said judgment.

3. For the aforesaid reasons, this Writ Petition fails.

4. In the result, this Writ Petition is dismissed.

5. As a sequel thereto, miscellaneous applications, if any, pending in the Writ Petition shall stand closed.
