HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.21115 OF 2016 ORDER:
The case of the petitioner is that the 4th respondent is trying to mutate his name in respect of the land admeasuring 30 guntas in Survey No.40/E, 1.01 guntas in Survey No.50/E and 0.25 guntas in Survey No.95/A3 of Kamalpalli Village, Jharasangam Mandal, Medak District, of which the petitioner is the owner by virtue of registered gift deed vide document No.779, dated 29.03.1994 and the petitioner's name is also entered in the revenue records. Though the petitioner made representations to the 3rd respondent on 18.06.2016 and to the 2nd respondent on 22.06.2016, the 2nd and 3rd respondents are trying to mutate the subject property in favour of 4th respondent. Aggrieved by the same, present writ petition is filed.
Heard learned counsel for the petitioner.
Learned Assistant Government Pleader for Revenue submits that only after considering the objections of the affected parties, necessary orders will be passed and the writ petition is premature.
The prayer in the writ petition itself is that the respondents are trying to mutate the petitioner's land in favour of respondent No.4 as such, the writ petition is premature. However, the respondent authorities shall consider the objections of the affected parties before mutating the names of the persons. Since the learned Assistant Government Pleader for Revenue states that they would consider the objections of the affected parties before affecting any mutation in the revenue records and that sofar they have not received any application from the 4th respondent for mutation, the writ petition is premature and the same is filed on apprehension. As such, I do not see any merits in the writ petition. Accordingly, the writ petition is dismissed. However, if any application is made by the 4th respondent the respondent authorities shall consider the same after receipt of objections from the affected parties. No order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
