THE HON'BLE DR. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.11020 of 2017 ORDER:

Heard learned counsel for the petitioners/A.1 to A.3 and learned Additional Public Prosecutor for the respondent State, and perused the record.

This petition is filed under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioners/A.1 to A.3 in Crime No.20 of 2016 of Gurrampode Police Station, Nalgonda District, for the offences punishable under Sections 417, 420, 376 and 109 IPC and Section 3(1)(w),(1)(5) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. It is brought to the notice of this Court that A.1 married to victim. As per the material placed on record, there are specific allegations of constituting offence punishable under the provisions of the above said Act. For the offences of this nature, there is a bar to grant bail under Section 438 Cr.P.C. The marriage would not be a ground to allow this petition. It is not appropriate to enlarge the petitioners/A.1 to A.3 on bail under Section 438 Cr.P.C.
