THE HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.384 of 2016 ORDER:

This application is filed to withdraw O.P.No.86 of 2015 from the file of Family Court, Kadapa, and transfer the same to Family Court, Kurnool.

2. Wife filed this application. According to her affidavit, her marriage with respondent was performed on 27.02.2014 at Namasthe Function Hall, Kurnool, as per Muslim rites and custom. She stated that after marriage, they lead life happily for few months and thereafter, respondent started harassing her and as the harassment reached peak, she left the company of respondent and lodged a complaint with Women Police Station, Kurnool, but on the undertaking given by respondent, said compliant was closed. She stated that subsequently, respondent filed O.P.No.86 of 2015 before Family Court, Kadapa, for restitution of conjugal rights. She stated that she appeared before Court at Kadapa and respondent, along with third parties, threatened her saying if she appears and contest O.P., she has to face dire consequences. She further stated that she being a lady, it is difficult for her to attend Court at Kadapa, which is around 150 kilometres from her place of residence. For these reasons, she prayed for transfer of O.P.No.86 of 2015 from the file of Family Court, Kadapa, to Family Court, Kurnool.

3. As seen from the record, notice sent to respondent through office is duly served on him and in spite of service of notice, respondent neither appeared in person nor through any advocate.

4. Heard arguments of advocate for petitioner.

5. Considering the reasons stated in the affidavit filed in support of

this petition and also considering the convenience of wife, O.P.No.86 of 2015 is withdrawn from the file of Family Court, Kadapa, and transferred to Family Court, Kurnool, for disposal in accordance with law.

6. The petition is ordered accordingly. No costs. Miscellaneous petitions, if any, pending in this petition, shall stand dismissed. ___________________ S. RAVI KUMAR, J 24th August, 2016.
