Petition filed under Section 438 of Cr.P.C. praying that in the circumstances stated in the petition and grounds thereof, the High Court may be pleased to grant anticipatory bail to the Petitioner/Accused No. 18 in the event of his arrest in connection with Crime/FIR No. 179 of 2017 on the file of the Station House Officer, Mttampally Police Station, Suryapet District. The petition coming on for hearing, upon perusing the memorandum of grounds filed in support thereof and upon hearing the arguments of Sri Leela Prasad Marella, Advocate for the Petitioner and the Addl. Public Prosecutor(TS) for the Respondent-State, the Court made the following ORDER :- "This Criminal Petition is filed under Section 438 of Cr.P.C. for grant of anticipatory bail to the petitioner-A.18 in Crime No.179 of 2017 of Mattampally Police Station, Suryapet District, registered for the offences punishable under Section 420 I.P.C. and Section 7 of the Essential Commodities Act, 1955. 2.

Heard the learned counsel for the petitioner-A.18 and the learned Additional Public Prosecutor appearing for the respondent-State, apart from perusing the material available on record.

The specific accusation against the petitioner-A.18 is that he knowingly allowed his Scorpio car bearing No.AP 10AR 4003 to illegally transport 20 bags of PDS rice. The petitioner-A.18 is doing business in transport. Whether he has knowledge of the nature of rice alleged to have been transported by his Scorpio car or not can be decided only after completion of regular trial. Having regard to the nature of allegations and the material collected, the petitioner-A.18 can be granted anticipatory bail under Section 438 Cr.P.C. 4.

In the result, the petitioner-A.18 is directed to surrender before the Station House Officer, Mattampally Police Station, Suryapet District, within a period of 15 days from today. On such surrender, the Station House Officer, Mattampally Police Station, shall release the petitioner-A.18 on bail on petitioner-A.18 executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the same S.H.O. On release, the petitioner-A.18 shall abide by the conditions mentioned in Section 438(2) Cr.P.C. and cooperate with the investigating officer. The petitionesr-A.18 shall also attend before the Station House Officer, Mattampally Police Station, Suryapet District, on every Sunday between 9-00 a.m. and 10-00 a.m. till filing of the charge sheet. Accordingly, this Criminal Petition is allowed. As a sequel, miscellaneous petitions, if any, pending in this Criminal Petition shall stand closed. "
