THE HON'BLE DR. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.11183 OF 2017 ORDER:

Heard learned counsel for the petitioner/accused, learned Additional Public Prosecutor for the respondent State and perused the record.

This petition is filed under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner/accused in Crime No.63 of 2017 of Chiragpally Police Station, Sangareddy District, for the offence punishable under Section 304-II IPC.

Learned counsel for the petitioner would submit that the petitioner is an innocent person and is not responsible for the alleged offence and ultimately prayed to allow the petition. Learned Additional Public Prosecutor opposed the grant of bail to the petitioner.

The material on record reveals that the wife of the deceased lodged a report with the police on 19.09.2017 at 9.00 a.m. stating that her husband, Bellapur Eshwar, took the goats for grazing on 18.09.2017 and did not return home. Thereafter, the police have started searching for her husband and ultimately, on 19.09.2017 morning, they found her husband dead due to electric shock at the petitioner's agricultural land in Sy.No.146. It is mentioned that in order to protect the maize crop, the petitioner fenced electric wire around it. The allegations are grave. The matter requires investigation. Release of petitioner on bail would hinder the investigation. It cannot be said that the prosecution case is false and the petitioner is falsely implicated in this case. This petition is devoid of merit and liable to be dismissed.
