HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 14876 of 2002 ORDER:
This writ petition is filed seeking to issue a writ of certiorari calling for the record relating to and connected with I.D.No.113 of 1998 on the file of the 1st respondent-Labour Court and quash the award dated 16.03.2001 passed therein insofar as denying back wages to the petitioner.
Heard learned counsel for the petitioner and learned standing counsel for TSRTC appearing on behalf of the 2nd respondent. When the matter is taken up for hearing, it is noticed that the petitioner has attained the age of superannuation and the issue raised in the writ petition is as to denial of back wages to the petitioner. The Labour Court, while exercising the power under Section 11-A of the Industrial Disputes Act and applying the proportionality theory, has rightly passed the award in favour of the petitioner. Further, no illegality or irregularity has been pointed out by the learned counsel for the petitioner in the award passed by the Labour Court. Unless and until any illegality or irregularity is pointed out by the learned counsel for the petitioner, this Court cannot interfere with the award passed by the Labour Court. The writ petition is devoid of merits.
Therefore, the writ petition is dismissed. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs.
