Heard learned counsel for the petitioners/accused Nos.3 & 4 in C.C.No.823 of 2017 on the file of XI Metropolitan Magistrate, Cyberabad at L.B. Nagar, registered for the offences punishable under Sections 341, 506 & 120-B r/w 34 IPC and Section 25(1)(b) of Arms Act and also learned Public Prosecutor representing the State and perused the grounds urged in the quash petition and the police final report and the contents of the FIR. The material is otherwise insufficient before this Court that too when liberty is available to approach the trial Court by filing application under Section 239 Cr.P.C. if at all there are no grounds, to discharge, by virtue of this order to receive additional material on their behalf in addition to the prosecution from the expression of Rukmini Narvekar Vs. Vijay Sataredkar1. With these observations, the Criminal Petition is disposed of by also giving the liberty to the petitioners to file application under Rule 37 of Criminal Rules of Practice for one to represent the others before the learned Magistrate, for the learned Magistrate to hear and consider.
