THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION NO.10199 OF 2017 ORDER:

This criminal petition is filed under Section 482 of Criminal Procedure Code to quash the proceedings in Crime No.735 of 2017 on the file of IX Metropolitan Magistrate, Cyberabad at Kukatpally. Sri K. Surender, learned counsel for the petitioners, requested this Court to direct the IX Metropolitan Magistrate, Cyberabad at Kukatpally to consider their application, under Rule 35 of Criminal Rules of Practice and Circular Orders, 1990. But, this Court cannot issue such direction and at best, this Court can direct the Trial Court to dispose of the application, in accordance with law.

Accordingly, the criminal petition is disposed of, directing the IX Metropolitan Magistrate, Cyberabad at Kukatpally to dispose of the application, if any, filed before it, in accordance with law.

With the above directions, the petition is disposed of, without touching the merits of the case. No costs.

Consequently, miscellaneous petitions pending, if any, shall also stand closed.
