HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.41575 of 2016 ORDER:

The present writ petition is filed by the petitioner under Article 226 of the Constitution of India, seeking to declare the inaction of the respondents 1 to 6 in arresting the 7th respondent, who is the husband of the petitioner, even though the petitioner made a complaint before the 5th respondent on 23.06.2015, as illegal and arbitrary, and consequently, direct the respondents 1 to 6 to arrest the 7th respondent and investigate the case in Crime No.98 of 2015.

Heard and perused the material available on record. The main grievance of the petitioner is that she lodged a complaint on 23.06.2015 before the Station House Officer, Karapa Police Station, East Godavari District - 2nd respondent, against her husband i.e. the 7th respondent and basing on the same, the 2nd respondent registered Crime No.98 of 2015. Though the complaint was registered on 05.08.2015, the 2nd respondent is not taking steps to conduct investigation in the aforementioned crime.

Considering the facts and circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, the 5th respondent is directed to conduct investigation in the above crime, complete the same and file a final report, as expeditiously as possible. With the above directions, the Writ Petition is disposed of. No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
