W.P.No.40168/2018 THE HON'BLE SRI JUSTI CE V. RAMASUBRAMANI AN WRI T PETI TI ON No.40168 of 2018 ORDER: (Per VRS,J.) The petitioner has come up with the above writ petition seeking a Mandamus to direct the Bank not to proceed with e-auction of the secured asset.

2. Heard Mr. Gurram Venkatramana, learned counsel for the petitioner. Mr. Dishit Bhattacharjee, learned counsel takes notice for the Bank.

3. As a matter of fact, the Bank has obtained an order under Section 14 of the SARFAESI Act from the Chief Metropolitan Magistrate, Syberabad. As against the said order, the petitioner had not approached any forum.

4. Instead the petitioner has come up with the above writ petition seeking a very strange prayer to direct the respondents to stop e-auction of the property. But so far no e-auction notice has been issued. Therefore, insofar as e-auction is concerned the writ petition is premature. Hence it is dismissed. There shall be no order as to costs.

5. As a sequel, pending miscellaneous petitions, if any, shall stand closed.
