THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.10204 of 2017 ORDER:

This petition is filed under Section 482 of Criminal Procedure Code to quash the order, dated 14.03.2016 in issuing look out circular against the petitioner.

During hearing, learned counsel for the petitioners submitted that the parties entered into Memorandum of understanding and terms and conditions were complied with, but due to absence of this petitioner in India, charge sheet filed and look out notice was issued today. Learned counsel for the petitioner further submitted that the petitioner is ready to appear before the Court, if time is granted subject to recalling look out circular.

Learned counsel for the 3rd respondent agreed for the request made by learned counsel for the petitioner. In view of the consent of both counsel, without touching the merits of the case, the petitioner is directed to appear before the XIII Additional Chief Metropolitan Magistrate, Hyderabad on or before 01.02.2018. Till then, the look out circular is kept in abeyance. In the event, the petitioner appear before the Magistrate, the look out circular is deemed to have been cancelled, otherwise, the authorities are at liberty to proceed in accordance with law.

With the above observation, the criminal petition is disposed of.

Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
