HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.13112 of 2016 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue appearing for respondents.

The petitioner contends that he had suffered an order under the provisions of the AP (Telangana Area) Tenancy and Agricultural Lands Act, 1950 on 25.08.2015 passed by respondent No.3 in favour respondents 4 to 16; that the petitioner questioned the same by way of an appeal being Appeal No.F1/1013/2016 before respondent No.2 along with stay application; but respondent No.2 is not passing any orders on the stay application.

Learned counsel for the petitioner contends that there is an immediate threat of dispossession of the petitioner from the subject land and that the action of respondent No.2 in not dealing with the stay application filed in the above appeal by the petitioner is arbitrary and illegal.

Learned Government Pleader for Revenue appearing for respondents 1 to 3 states that respondent No.2 will dispose of appeal preferred by the petitioner, within three months from the date of receipt of a copy of this order, after hearing respondents 4 to 16.

Therefore, the Writ Petition is disposed of directing respondent No.2 to dispose of Appeal No.F1/1013/2016, preferred by the petitioner, challenging the order dt.25.08.2015 passed by respondent No.3, within three months from the date of receipt of a copy of this order, after hearing respondents 4 to 16. Till the disposal of the said appeal, there shall be stay of all further proceedings, pursuant to the order dt.25.08.2015 in File No.G/1500/2014 passed by respondent No.3. No costs.

Consequently, the miscellaneous applications pending, if any, in this Writ Petition shall stand dismissed.
