HON'BLE DR JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.11066 of 2017 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/accused No.4 for grant of bail in the event of his arrest in connection with Crime No.736 of 2017 of Hayathnagar Police Station, Ranga Reddy District, registered for the offences punishable under Sections 387, 307 and 120 (B) read with 34 IPC. 2.

Heard the learned counsel for the petitioner/accused No.4, learned Additional Public Prosecutor representing the respondentState and perused the record. 3.

Learned counsel for the petitioner/A.4 would submit that the petitioner is an innocent person and falsely implicated in this case; the petitioner did not receive any money from any accused nor he paid any money to any other accused; the petitioner is not aware of the alleged conspiracy, he has no relation with the other accused in this case and prayed to allow the application. 4.

On the other hand, the learned Additional Public Prosecutor opposed grant of bail to the petitioner/accused No.4. 5.

The material on record reveals that L.W.1 and accused No.1 were running two hospitals, viz., Jeevan Hospital at Hyderabad and Sri Sai Hospital at Peddapalli. There were financial differences among them. Thereafter, accused No.1 bore grudge against L.W.1 and wanted to eliminate L.W.1. He contacted

accused No.2, thereafter accused No.3. After due discussions, accused No.1 agreed to eliminate L.W.1 on payment of Rs.10,00,000/-. Accused No.1 has sent Rs.50,000/- through accused No.4. The petitioner/A.4 is aware of the conspiracy. Accused Nos.2 and 3 are also part of the conspiracy. Accused No.1 pressurised accused No.2 to execute the plan. Accused No.4 also alleged to have contacted accused No.2 regarding the causing of murder of L.W.1. The cell phone of petitioner/A.4 was seized. There are specific accusations against the petitioner/A.4. The allegations are grave. The matter requires thorough investigation. It is not a fit case to grant bail to the petitioner/A.4 under Section 438 Cr.P.C.
