Petition filed under Sections 437 & 439 of Cr.P.C. praying that in the circumstances stated in the Grounds of Criminal Petition, the High Court may be pleased to release the petitioner/Accused No.4 on bail in Crime No. 516 of 2017 of Police Station, Narsingi, Cyberabad District, pending investigation, enquiry and trial. The petition coming on for hearing, upon perusing the memorandum of grounds filed in support thereof and upon hearing the arguments of Sri P. Prabhakar Reddy, Advocate for the Petitioner and the Addl. Public Prosecutor(AP) for the Sole Respondent-State, the Court made the following ORDER :- "Heard learned counsel for the petitioner/A.4 and learned Additional Public Prosecutor for the respondent State, and perused the record. This petition is filed under Section 439 Cr.P.C. for grant of bail to the petitioner/A.

4 in Crime No.516 of 2017 of Narsingi Police Station, for the offence punishable under Section 20(b)(ii)(c) of NDPS Act. The material on record reveals that the petitioner/A.4 was remanded to judicial custody on 22.07.2017. No ganja was seized from the petitioner/A.4. The petitioner/A.4 is made as accused in this case, on the confession of A.2 and A.3. A.2 and A.3 are made as accused pursuant to the confession of A.5 and A.6. It is brought to the notice of this Court that A.5 and A.6 were granted bail by the trial Court. Under these circumstances, the petitioner/A.4 can also be enlarged on bail on some conditions.

In the result, the petitioner/A.4 is ordered to be released on bail on his executing a personal bond of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum each to the satisfaction of the learned XXIII Metropolitan Magistrate, Cyberabad at Rajendranagar. On such release, the petitioner/A.4 shall attend before the Station House Officer, Narsingi Police Station, on every Sunday between 9.00 and 10.00 a.m. till filing charge sheet.
