SIVA SANKARA RAO WRIT PETITION No.9271 of 2016 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) Challenge in this writ petition was to the Tender/Auction sale notice dated 20.02.2016, whereby the respondent bank proposed to hold the auction sale on 24.03.2016.

By order dated 22.03.2016, this Court directed the respondent bank not to finalise the said sale subject to the petitioner depositing a sum of Rs.1,00,000/- within a time frame.

Though Sri Nageshwar Rao Pujari, learned counsel for the petitioner, states that the petitioner has complied with the afore-stated conditional order, Sri Ch. Siva Reddy, learned counsel for the respondent bank, would state that the auction sale scheduled to be held on 24.03.2016 did not materialise for want of bidders. In that view of the matter, the challenge in this writ petition to the auction sale notice dated 20.02.2016 does not survive for consideration on merits.

The writ petition is accordingly dismissed leaving all issues open.

Interim order dated 22.03.2016 shall stand vacated. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
