THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.39044 OF 2016 ORDER:

The writ petition is filed by the petitioners seeking a writ of mandamus declaring the action of the third respondent in interfering with the liberty of the petitioners and in calling them to the police station as illegal and arbitrary, and to pass such other order or orders in the interest of justice. Heard and perused the material.

Learned counsel for the petitioners submits that the petitioners have not committed any offences and that they are students and they need to attend the examinations. He further submits that the complainant has filed false complaint against the petitioners herein without any valid grounds. He further submits that Non Bailable Warrants (NBWs) are issued against the petitioners and as such, he prays this Court to recall the NBWs pending against the petitioners.

Considering the facts and circumstances of the case and also as the petitioners are students and they need to attend the examinations, the Non Bailable Warrants issued against the petitioners are hereby recalled. The petitioners are directed to appear before the Court concerned on or before 08.12.2016 and thereafter continue to appear before the Court concerned regularly without fail.
