HON'BLE SRI JUSTICE SURESH KUMAR KAIT Criminal Petition No.16795 of 2016 ORDER:

Vide the present criminal petition, petitioner seeks direction to enlarge him on bail in connection with Crime No.219 of 2016 of Kadiam Police Station registered for the offences punishable under Sections 8(a)(c) and 20(b)(ii)(c) of Narcotic Drugs & Psychotropic Substance Act read with Section 34 IPC.

The petitioner earlier moved Criminal Petition No.16475 of 2016 for the same relief and the same was dismissed by this Court on 06.12.2016. This fact has not been mentioned in the present petition. The petitioner concealed the said fact and moved this application without any changed circumstances from the date of order.

Keeping in view the fact that the quantum of 420 kgs. ganja seized from the petitioner's lorry and that concealment of earlier Crime No.77 of 2016 registered against him, I am of the view that the petitioner is a habitual offender. Therefore, the criminal petition deserves to be dismissed.

The criminal petition is accordingly dismissed. Miscellaneous petitions if any pending in this petition shall stand infructuous.
