Chippa Anjaiah, S/o. Nagappa Petitioner (Accused No.3 in Cr.No.143/2014 of Sadashivpet P.S., Medak Dist) AND The State of Telangana, rep. by Public Prosecutor, High Court at Hyderabad, through P.S. Sadashivpet, Medak District (Now Sangareddy District) Respondent/Complainant Petition under Sections 437 & 439 of Cr.P.C. praying that in the circumstances stated in the grounds filed herein, the High Court may be pleased to enlarge the petitionier/Accused No.3 on bail in SC.No. 37 of 2016 on the file of Spl. Judge for trial of offences under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989-cum-V Additional Sessions Judge, Medak at Sangareddy. The Petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri P.Prabhakar Rao, Advocate for the Petitioner and of the Addl. Public Prosecutor (TG) for the Respondent, the Court made the following ORDER:

" Heard learned counsel for the petitioner/A.3 and learned Additional Public Prosecutor for the respondent State, and perused the record. This petition is filed under Section 439 Cr.P.C. for grant of bail to the petitioner/A.3 in S.C.No.37 of 2016 on the file of Special Judge for Trial of Offences under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989-cum-V Additional Sessions Judge, Medak at Sangareddy, for the alleged offence under Section 304-B IPC.

Earlier, the petitioner/A.3 was granted bail in this case. Later, he could not appear before the trial Court due to illness. When the petitioner/A.3 appeared before the trial Court to get recall NBW, the recall petition was dismissed and he was remanded to judicial custody on 18.09.2017. Now, learned counsel for the petitioner/A.3 would submit that the petitioner/A.3 is ready to attend the Court and conduct his defence regularly. Under these circumstances, the petitioner/A.3 can be enlarged on bail.

In the result, the petitioner/A.3 is ordered to be released on bail on his executing a personal bond of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum each to the satisfaction of the learned Special Judge for Trial of Offences under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989-cum-V Additional Sessions Judge, Medak at Sangareddy.
