THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE M.GANGA RAO WRI T PETI TI ON No.40088 OF 2018 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) The petitioner is the unsuccessful applicant in O.A.No.1317 of 2018 on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad, which was dismissed by order dated 23.10.2018. Her prayer in the said O.A. was only to direct the authorities to consider and pass appropriate orders on her representation dated 13.12.2017. The Tribunal however went into the contents of the said representation and opined that in the event the petitioner-applicant was aggrieved by any promotions given to others, she ought to have filed an appeal.

Sri K.R.Srinivas, learned counsel for the petitioner-applicant, would point out that the issue as regards promotions being effected in relation to other employees only formed part of the representation as the main grievance of the petitioner-applicant was that the post meant for hearing handicapped was kept vacant and that she was the only candidate who was eligible to be promoted thereto.

In any event, as the petitioner-applicant's representation dated 13.12.2017 is stated to be still pending consideration before the Regional Director of Medical and Health Services, Visakhapatnam, the second respondent herein, we dispose of this writ petition setting aside the order dated 23.10.2018 passed by the Tribunal in O.A.No.1317 of 2018 and directing the second respondent to consider the petitioner-applicant's representation dated 13.12.2017 on its own merits and pass appropriate orders thereon in accordance with law. This exercise shall be completed

expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order.
