THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.19350 OF 2016 ORDER:

The case of the petitioner is that he is the owner and possessor of the land to an extent of Ac.2.72 cents in Sy.No.425/1B, Jammalapalem Revenue village, Jaladanki Mandal, SPSR Nellore District, having inherited the same from his father. While so, out of Ac.2.72 cents an extent of 0.53 cents was claimed by one China Mala Kondaiah and against the same the petitioner's father filed revision under Section 9 of the A.P.Rights in Land and Pattadar Pass Books Act, 1971 and the same was allowed by the 2nd respondent vide order dated 27.08.2011, canceling the Pattadar Pass Books issued in favour of China Mala Kondaiah and further directed the Sub-Registrar, Kavali to take action to cancel the Registration Document No.383/2009 in which the lands were registered in Sub Registers Office.

Aggrieved by the aforesaid order, son of China Mala Kondaiah filed writ petition and this Court on 27.09.2011 passed orders in WP.MP.No.33275/2011 in WP.No.26942/2011 suspending the order dated 27.08.2011 to an extent of canceling the Registration Document No.383/2009. Thereafter, the petitioner filed application on 03.02.

requesting him to direct the 4th respondent to consider his application and for issuance of Pattadar Pass book. The petitioner also filed application in Form-6A for issuance of Pattadar Pass Books and title deeds. As no orders are passed present writ petition is filed.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.

Since it is stated that the application filed by the petitioner in Form-6A for issuance of pattadar pass books and title deeds is pending before the 4th respondent, the 4th respondent is directed to consider the same and pass appropriate orders in accordance with law after issuing notice to all the affected parties.

With the above direction, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
