THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION NO.40070 OF 2018 ORDER:

The petitioner has been elected as Sarpanch of Bandlaguda Jagir Gram Panchayat in the elections held in the year 2014. By order dated 27.12.2017, he was removed from the office of the Sarpanch of Banglaguda Jagir Gram Panchayat on the allegation of misappropriation of Gram Panchayat funds. Aggrieved thereby, the petitioner preferred an appeal before the Government. By order dated 27.02.2018, the Government stayed the orders of removal dated 27.12.2017. Alleging that the said stay order is not implemented, this Writ Petition is filed.

It is not disputed that the appeal is pending consideration with the Government. The stay order was granted by the Government on 27.02.2018. Be that as it may, the petitioner is out of the office of the Sarpanch for the last seven months. At this stage, without seeking for disposal of the appeal pending with the Government for about one year, this Writ Petition is filed seeking implementation of the interim orders passed by the Government staying the order of removal from the office of the Sarpanch. In other words, the petitioner is seeking implementation of the direction issued by the Government.

There is no material placed on record to show that the petitioner brought to the notice of the Government that the orders passed by the Government are not implemented. However, without entering into the merits of the issue, since the appeal is pending consideration with the Government and even though stay was granted on 27.02.2018, the same is not complied with, this Court

is inclined to dispose of the Writ Petition directing the Government to consider the appeal and pass final orders in it, as expeditiously as possible, preferably within six (6) weeks from the date of receipt of a copy of this order.

The Writ Petition is, accordingly, disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
