This petition is filed under Section 438 Cr.P.C. to grant anticipatory bail to the petitioner-A3 for the offences alleged under Sections 420, 464 and 467 IPC.

Heard learned counsel for the petitioner-A3, learned Additional Public Prosecutor representing the State and perused the record. 3.

Learned counsel for the petitioner-A3 would submit that the petitioner-A3 is innocent person and falsely implicated in this case. The petitioner-A3 was already arrested and remanded to judicial custody in other similar case of different Police Station and was granted regular bail and ultimately, prayed to allow the petition. 4.

On the other hand, learned Additional Public Prosecutor opposed the grant of bail to the petitioner-A3. 5.

As per the material placed on record, A1 used to prepare pass books in a printing press situated at Karnataka and handover the same to the petitioner-A3. The petitioner-A3 used to handover those fabricated pass books to different persons to seek loan, particularly crop loan and other loans from the Nationalized Banks. Each pass book was sold for the price of Rs.10,000/- to Rs.15,000/-. The allegations are grave. The release of the other accused would not entitle the petitioner-A3 to seek bail under Section 438 Cr.P.C. There are distinct causes of actions to register the crime and investigate. The release of the petitioner-A3 would hinder investigation. There is

possibility of causing disappearance of the material evidence. Therefore, it is not a fit case to grant bail to the petitioner-A3 under Section 438 Cr.P.C.
