THE HON'BLE SRI JUSTICE SANJAY KUMAR CONTEMPT CASE No.345 of 2016 ORDER:
This Contempt Case was filed alleging willful disobedience to the order dated 25.01.2016 passed by this Court in Writ Petition No.1885 of 2016.
By the said order, this Court directed the police authorities to act in terms of the judgment of the Supreme Court in LALITA KUMARI v. GOVERNMENT OF UTTAR PRADESH[1].
The Sub-Inspector of Police, Gadwal Town Police Station, Mahabubnagar, filed a counter-affidavit stating that upon receipt of the petitioner's complaint dated 06.01.2016, detailed preliminary enquiry was conducted and as it was found that the matter was purely civil in nature, the petitioner was informed that the case did not warrant registration of an offence under penal laws by way of a communication sent under registered post on 07.02.2016. A copy of the letter along with the acknowledgment card evidencing receipt thereof by the petitioner is placed on record.
In that view of the matter, this Court finds no disobedience, much less willful disobedience, to the order
passed by this Court warranting exercise of contempt jurisdiction.
The Contempt Case is accordingly closed. It is left open to the petitioner to workout his remedies in accordance with law.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
