This Court not felt it just to sub serve the ends of justice to accord permission to compound the non-compoundable offences, hence Crl.P.M.P.Nos.10856 & 10857 of 2017 are dismissed. Heard.

Leave about the fact that the committal Magistrate duty is practically a post office duty subject to compliance of the Clauses (a) to (d) of Section 209 Cr.P.C., on committal, the petitioner is entitled to file application for discharge as contemplated by Section 227 Cr.P.C. before the learned Court of Sessions, for the learned Sessions Judge to decide on own merits.

Having regard to the above and in the result, the Criminal Petition is disposed of by left open all available defence of the accused.
